The agreement between you and Baseline Sites when you engage us to design, build or look after your website.

These Terms & Conditions ("Terms") apply to the website design, development and care plan services ("Services") provided by Baseline AI Pty Ltd (ABN 69 696 319 918) trading as Baseline Sites ("we", "us", "our"), to you, the client ("you"). By paying a deposit, signing up, or otherwise engaging us, you agree to these Terms. Please read them carefully.
We design and build websites, and provide optional ongoing care plans. The specific deliverables, page count and inclusions depend on the plan you select and any add-ons confirmed in writing. We design every site individually and do not resell stock templates.
All prices are in Australian dollars and include GST unless stated otherwise. One-off build fees and monthly care plan fees are as shown on our website at the time of your order, or as set out in a written quote we provide.
We aim to deliver Starter sites within five business days of receiving your completed brief and all required materials. Timeframes are estimates and depend on you providing content, feedback and approvals promptly. Delays in providing materials or feedback will extend the timeline accordingly.
Each plan includes the number of revision rounds stated for that plan. Additional revisions or changes outside the agreed scope may be quoted separately and charged at our standard rates.
You are responsible for providing, or authorising us to create, the text, images, logos and other materials for your site. You warrant that you own or are licensed to use all materials you provide, and that they do not infringe any third party's rights or any law. You agree to indemnify us against any claim arising from materials you supply.
Care plans are optional and cover hosting, security, daily backups, software updates, performance monitoring and minor content edits, as described for your plan. Care plans commence after your site goes live, run on a 12-month term, and may be cancelled at the end of that term or as otherwise agreed. There is no cancellation fee. If a care plan is cancelled or lapses, responsibility for hosting, security and maintenance passes to you.
Once all fees for your build are paid in full, ownership of the final website design and custom content we created for you transfers to you. We retain ownership of any underlying tools, frameworks, code libraries and know-how used to produce the site. We may showcase your site and a description of the work in our portfolio and marketing unless you ask us in writing not to.
Your site may rely on third-party services such as hosting providers, domain registrars, plugins and integrations. Those services are governed by their own terms, and we are not responsible for their availability, performance or pricing changes.
You may cancel before we begin work for a full refund of your deposit. Once work has commenced, the deposit covers work performed and is non-refundable, but you will not be charged the balance for work not yet done. Nothing in these Terms excludes rights you have under the Australian Consumer Law.
We provide our Services with due care and skill. To the extent permitted by law, and except for guarantees that cannot be excluded under the Australian Consumer Law, our total liability to you is limited to re-supplying the Services or refunding the fees paid for the affected Services. We are not liable for indirect or consequential loss, including loss of profits or data.
We handle your personal information in line with our Privacy Policy, which forms part of these Terms.
We may update these Terms from time to time. The version published on our website at the time you place an order applies to that order.
These Terms are governed by the laws of South Australia, and you submit to the non-exclusive jurisdiction of the courts of that State.
